FINRA Record Retention IT Checklist

The 12 technical requirements behind FINRA Rule 4511 and SEC Rule 17a-4 — WORM storage, email archiving, retention schedules by record type — with a plain-English score guide. Save this page or print it (Ctrl/Cmd+P).

⚠ FINRA examinations regularly cite retention violations — not because firms don't know the rules, but because their IT doesn't meet the technical spec.

1
Documentation
Documented retention schedule, specified by record type
General ledgers and blotters: 6 years. Original order tickets: 3 years. Communications (email, text, chat): 3 years. Customer account records: 6 years after the account closes.
2
Storage
WORM-compliant storage or SEC Rule 17a-4 certified cloud archiving
In place for every category of required record — not just the ones that feel most sensitive.
3
Documentation
Vendor certification on file confirming Rule 17a-4 compliance
Your archiving vendor should be able to hand you documentation confirming their platform is actually certified — don't take "cloud storage" at face value.
4
Storage
Records preserved in a genuinely non-rewriteable, non-erasable format
A standard backup drive, a shared file-server folder, or most generic cloud storage does not meet this standard by default.
5
Access
Records immediately accessible for the first two years
"Accessible within a reasonable time" is the standard for the remainder of the retention period — but the first two years require immediate access.
6
Access
Records reproducible on paper or in a usable electronic format on request
If you can't actually produce a clean copy when asked, storing the record in the first place hasn't satisfied the rule.
7
Email
Email archiving capturing 100% of firm email, in real time, immutable
Including any personal accounts used for business — every email connected to firm business is a required record under FINRA rules.
8
Email
Not relying on a standard mailbox as the compliance mechanism
A Microsoft 365 mailbox alone isn't a compliant archive — emails can be deleted and retention policies can be changed, so the mailbox itself is not WORM-compliant by default.
9
Communications
Mobile device policy addressing texting and off-channel communications
2023's FINRA enforcement actions against major broker-dealers over off-channel communications are a reminder this applies to personal texts too, not just the firm's official system.
10
Communications
Social media / electronic communication archiving, if those channels are used for business
Any channel used to conduct or discuss business needs the same retention treatment as email.
11
Administrative
Tested restoration process
You can actually retrieve and produce records when needed — not just confirm they were stored somewhere at some point.
12
Administrative
Annual review of retention policies against current FINRA/SEC requirements
Rules and interpretations shift — a policy that was compliant three years ago isn't automatically compliant today.

6–9 checked Moderate exposureReal gaps — most firms land here on email archiving specifically. Close these before FINRA finds them.
