← Back to pbonconsulting.comThese Terms of Use (the “Terms”) are an agreement between you and P-Bon Consulting Services Incorporated (“P-Bon Consulting,” “we,” “us,” or “our”). They govern your use of the website located at pbonconsulting.com (the “Site”) and your purchase and use of our digital products, including the Medical AI Readiness Vault (the “Digital Products”). By accessing the Site or purchasing a Digital Product, you agree to these Terms. If you do not agree, please do not use the Site or purchase our products.
You may use the Site for lawful purposes only. You agree not to interfere with the operation or security of the Site, attempt to gain unauthorized access to any systems or data, scrape or harvest content in bulk, or use the Site to transmit malicious code. We may suspend or restrict access to the Site at any time without notice.
All content on the Site and in our Digital Products — including text, frameworks, checklists, templates, training materials, graphics, and logos — is owned by P-Bon Consulting or its licensors and is protected by copyright and other intellectual property laws. Except for the limited license granted below, no rights in our content are transferred to you.
When you purchase a Digital Product, we grant you a limited, non-exclusive, non-transferable license to use the materials for the internal business purposes of a single organization. You may customize and deploy the templates and frameworks within your own organization. You may not:
Consultants or advisors who wish to use the materials with multiple client organizations must purchase a license for each client organization or contact us for multi-client licensing.
Purchases of Digital Products are processed by our third-party checkout provider, Lemon Squeezy, which acts as merchant of record and handles payment processing and applicable taxes under its own terms and policies. Digital Products are delivered electronically, typically immediately after successful payment, via a download link sent to the email address you provide. It is your responsibility to provide an accurate email address.
If a Digital Product does not provide frameworks you can deploy, you may request a full refund within 14 days of purchase by emailing info@pbonconsulting.com from the email address used at checkout. Refunds are issued to the original payment method through our checkout provider. After a refund, your license to use the materials ends and you must delete all copies.
Our Digital Products and Site content provide general information, frameworks, and templates for educational and operational purposes. They are not legal advice, medical advice, or a substitute for the judgment of qualified professionals, and purchasing or using them does not create an attorney-client, physician-patient, or consultant-client relationship. Compliance obligations (including HIPAA and state privacy and security laws) depend on your specific facts and circumstances. You are responsible for adapting any template or framework to your organization and, where appropriate, having it reviewed by your own qualified counsel or compliance professionals. Use of our materials does not guarantee compliance with any law or regulation or the outcome of any audit, examination, or proceeding.
Any consulting, managed IT, or advisory services we provide are governed by a separate written agreement or proposal between you and P-Bon Consulting. These Terms do not create a services engagement. Any complimentary consultation or strategy call included with a Digital Product is informational only.
The Site and Digital Products are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
To the maximum extent permitted by law, P-Bon Consulting will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or business opportunities, arising out of or related to your use of the Site or Digital Products. Our total aggregate liability for any claim arising out of these Terms or a Digital Product will not exceed the amount you paid us for that product in the twelve months preceding the claim.
You agree to indemnify and hold harmless P-Bon Consulting and its officers, employees, and agents from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or Digital Products or your violation of these Terms.
The Site links to and uses third-party services such as Lemon Squeezy (checkout), Formspree (forms), and Calendly (scheduling). Those services are governed by their own terms and privacy policies, and we are not responsible for their practices.
Our collection and use of personal information is described in our Privacy Policy.
We may update these Terms from time to time. When we do, we will revise the “Last Updated” date above. Continued use of the Site or Digital Products after changes are posted constitutes acceptance of the updated Terms. The version of the Terms in effect at the time of your purchase governs that purchase.
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute arising out of these Terms will be brought exclusively in the state or federal courts located in New York, and you consent to their jurisdiction.
